The Settlement Proposal Calculation System – SCAPA consists of a tool aimed at preparing settlement proposals for labor disputes, based on its own methodology, guided by risk management of the outcome of the process.The SCAPA methodology is based on the application of the following concepts: (1) Fragmented Risk Management: inspired by constructions of Behavioral Economics and Finance Sciences, it consists of the idea of ​​separately treating requests made in labor claims and promoting the individualized risk management. The risk management used in the tool derives from the notion of prospect or payoff, according to which the expected value in scenarios of uncertainty results from the quantity that can be obtained multiplied by the probability; (2) Variable-Based Negotiation: inspired by the idea of ​​Criteria-Based Negotiation, which is part of the Harvard Negotiation Model, according to which, to escape bargaining negotiations, it is necessary to discuss objective criteria. In the case of Variable-Based Negotiation, the debate for the search for consensus develops around the variables of each order, which would be the amount due in the case of acceptance of each postulated order in the process and the perception of the probability of success.To use the tool, the user must enter the following information:- modality of evaluation of the proposal, classified as neutral, optimistic and pessimistic;- estimation of the duration of the process;- postulated value for each order;- risk perception of the outcome for each order;- cost of the defendant with the maintenance of the process (if no agreement is signed);- considering the data entered, the tool displays the following information:- postulated total value;- value based on individualized risk management (does not consider the cost of the defendant);- proposal value, which corresponds to the value based on individualized risk management plus the cost of the defendant.
